Stipulation to Substitute Attorney (same firm)

Event: Bankruptcy > Multi Case Docketing > Firm Substitution of Attorney (FRBP 2014)

 

The substitution MUST be between attorneys from the same firm and signed by both departing and incoming attorneys when possible.  No order is necessary.  Notice to debtor(s) is the responsibility of the substituting attorney.  One proof of service with a list of affected debtors will be accepted and should be filed with the stipulation.

Filing Requirements:

  • Stipulation to Substitute Attorney

  • Proof of service with list of affected debtors

To File Electronically:

  1. Log into CM/ECF.

  2. Select [Bankruptcy >  Multi Case Docketing].

  3. Enter multiple case numbers (e.g, xx-xxxxx). Each case number must be on a separate line. Enter between each case number.

  4. Select [Firm Substitution of Attorney (FRBP 2014)] from the event list.

  5. Enter the Incoming and Outgoing Attorney information.

  6. Browse to select the Stipulation/proof of service/list of affected debtors (.pdf file(s)).

  7. Search for Incoming Attorney. Select name from List. If the party is not listed, click on Add/Create New Party.

  8. Select the party filer (debtors).

  9. End Attorney Selection.

    Note: The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association.

  10. Verify the final docket text; if correct, click [Next] to submit your document(s).

    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
