Canceling Hearing

Generally, Hearings May Be Canceled When:

  1. Motion is Withdrawn

  2. All Objections are Withdrawn

  3. A Settlement / Stipulation signed by all parties has been filed

  4. Trustee's Recommendation has been filed and there are no other pending objections.  

NOTE: If a hearing is set at a Judge's request, contact chambers prior to canceling the hearing.

Exceptions:

  1. Objections to 1) Chapter 11 Disclosure Statement, 2) Chapter 11 Plan, and 3) Chapter 12 Plan.

  2. A Disclosure Hearing or Chapter 11/12 Final Confirmation hearing may be changed to a Telephone Conference when there are no objections. **Refer to chambers for guidance.**

What To Do:

To remove the matter from the calendar, the clerk's office will make a hearing canceled entry on the docket and recode (strike) the matter from the CHAP calendar.

  1. Cancel Case in ECF

    1. Select [Bankruptcy/Adversary >  Court Events].

    2. Enter the case number (e.g. xx-xxxxx).

    3. Select [Hearing: Canceled] from the event list.

    4. Skip the Browse screen.

    5. Refer to the matter scheduled for hearing.

    6. Satisfy pending scheduled event (hearing date) by clicking on check box by the hearing entry that is to be canceled (there may be many so select carefully).

    7. Do you want an email sent to the Hearings Group? Select Yes if a preliminary hearing was to be held within a week from today's date or a final hearing was scheduled; Select No if the preliminary hearing was scheduled further out.

    8. Modify the text as appropriate. Complete boxes:  re: (type in the Matter or cut and paste from the docket). Originally scheduled for (type in the date and time). Canceled due to: (Reason e.g. Trustee has now recommended Chapter 13 Plan OR Parties have filed settlement Stipulation OR withdrawal of Objection OR withdrawal of Motion, etc.)

    9. Verify the final docket text; if correct, click [Next] to submit your document(s).

      Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.

  2. Update Hearing in CHAP Web:

    1. Select (highlight) the matter from the Court Calendar

    2. Change Sort Code to "sn" (aka Stricken from the calendar).

Note:  The calendar text will change to pink.
