  • Motion to Convert

  • Notice Requirements:

    • Chapter 11 to 7: No Notice required unless case was previously converted from a 7 to chapter 11. If the case was previously converted, a 21-day notice to all creditors is required.

    • Chapter 12/13 to 7: No Notice required. Also see Notice of Conversion

    • Any Chapter to 11, 12, or 13: A 21-day notice to all creditors is required.

  • Proposed Order

  • Proof of Service (required if Notice was provided)

  • Filing Fee:

    • Ch. 13 to Ch 7 is $25.00
    • Ch. 12 to Ch. 7 is $60.00
    • Ch. 11 to Ch. 7 is $15.00
    • Ch. 7 to Ch. 11 is $922.00. No fee is due to reconvert a case to a Ch. 11.
    • Ch. 13 to Ch. 11 is $932.00. No fee is due to reconvert a case to a Ch. 11.

      No Fee for the following: Ch. 7 to 12 or 13, Ch. 11 to 12 or 13, Ch. 12 to 11 or 13 and Ch. 13 to Ch. 12

    If current chapter is Ch. 7, 11, or 12: 21 days to object. Notice is sent to all creditors. Rule 2002(a)(4)

    If current chapter is Ch. 13: Usually 21 days to object to the parties in interest.

  • Proposed Order (may be filed after the last day to object has expired)

  1. Select [Bankruptcy >  Motions/Applications].

  2. Enter the case number (e.g, xx-xxxxx).

  3. Select [Convert Case... ] from the event list.

    To accurately report statistics to Congress, it is crucial that the correct event is selected.

  4. Select the party filer.

  5. Browse to select the Motion (.pdf file).

    Note:  Any supporting documents and Proof of Service may be added as attachments to this document.

  6. Remove the last day to object if converting to chapter 7. Generally, no notice is required.

    Note: Enter the last day to object if converting to a chapter other than chapter 7.

  7. To pay via credit card, leave the receipt field blank and select NEXT to continue filing.

    Note:  If no filing fee is due, enter "exempt."

  8. Modify the text as appropriate.

  9. Verify the final docket text; if correct, click [Next] to submit your document(s).

    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.

  10. Electronically file the Proposed Order. Instructions

  1. Select [Bankruptcy >  Motions/Applications].

  2. Enter the case number (e.g, xx-xxxxx).

  3. Select [Convert Case... ] from the event list.

    Note: If Motion to Convert is combined with a Motion to Dismiss, Ctrl and click to select both events. To accurately report statistics to Congress, it is crucial that the correct event is selected.  

  4. Select the party filer. If the party is not listed, click on Add/Create New Party.

    Note:  The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association.

  5. Browse to select the Motion (.pdf file).

    Note:  The Motion, Notice of Motion, and Proof of Service may be a single PDF; or the Notice, supporting documents, and Proof of Service may be added as attachments to this document. The Motion must be the first document in your PDF

  6. Enter the last day to object (defaults to 21 days; modify if necessary).

    Note:  Remove this date if you are not filing a Notice at this time.

  7. To pay via credit card, leave the receipt field blank and select NEXT to continue filing.

    Note: If filing fee is exempt, type "exempt" in receipt field.

  8. Modify the text as appropriate.

    Note: If you selected more than one relief type, select and/or from the second prefix box.

  9. Verify the final docket text; if correct, click [Next] to submit your document(s).

    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.

  10. U.S. Trustee will file the Notice of Motion [Bankruptcy > Trustee/US Trustee > Notice of US Trustee Motion to Convert or Notice of US Trustee Motion to Dismiss or Convert] The Court will send the notice to all creditors via the BNC.
